As an interactive computer service, FitnessTurtles.com is provided immunity by Congress in Section 230 of the Communications Decency Act of 1996 from being held responsible for material published to our site by users. As a user of this site, you will be held solely responsible for the content of any message that you post. If you post libelous, defamatory, slanderous, or otherwise untruthful remarks about a person or company, you could be putting yourself in legal jeopardy.
You agree that you will not post any content -- including text, communications, software, images, sounds, data, or other information -- that:
- contains profanity or vulgar language;
- is excessively insulting or argumentitive without merit, unlawful, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, contains explicit descriptions or accounts of sexual acts;
- victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
- is in any way offensive to others or in conflict with the general tone of FitnessTurtles.com content and services, such as content that is unsuitable or inappropriate for a family oriented audience;
- infringes on any patent, trademark, trade secret, copyright or other proprietary right of any party;
- constitutes unauthorized advertising or solicitations;
- contains software viruses or any other malicious computer code; or
- impersonates any person or entity
FitnessTurtles.com does not pre-screen content posted by users. However, FitnessTurtles.com and its agents have the right at their sole discretion to remove any content that, in the judgment of FitnessTurtles.com, does not comply with these membership rules or is otherwise harmful, objectionable, or inaccurate. FitnessTurtles.com is not responsible for any failure or delay in removing such content.
Registration is limited to one username per member. FitnessTurtles.com may, without prior notice, immediately terminate any or all of your accounts after discovering you have registered, and/or posted under, multiple usernames.
Advertisements and solicitations of any kind are strictly prohibited unless you are a paying site sponsor. You will not harvest or collect information about the users or members of this site or use such information for the purpose of spamming them via e-mail. You will not solicit our members with any type of commercial offer, or advertise your business through your posts or private messages, or profile page. This includes, but is not limited to, posting your phone or fax number(s) and posting any URLs or hyperlinks to your commercial web site(s) or email account(s). FitnessTurtles.comand its agents may remove or edit any posts, without prior notice, that contain unauthorized advertisements or solicitations. You agree that FitnessTurtles.commay, without prior notice, immediately terminate your membership upon discovery of any unauthorized advertising or solicitation.
FitnessTurtles.com does not want and cannot accept any ideas or content you consider proprietary. Consequently, any material you submit to this site will be deemed a grant of a royalty free non-exclusive right and license to use, reproduce, modify, display, transmit, adapt, publish, translate, create derivative works from and distribute these materials throughout the universe in any medium and through any methods of distribution, transmission and display whether now known or hereafter devised. In addition, you warrant that all so-called "moral rights" have been waived.
Because our site is an interactive community, you will likely receive automatically generated emails notifying you whenever there are replies to your posts. By becoming a member, you will also receive our community bulletin, which is an occasional email notifying you of new site features or events. You are always given the option to unsubscribe in each email. We do not provide your personal information to anyone for sharing or marketing purposes. However, we may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to conform with the law or comply with legal inquiries about the content of your posts.
FitnessTurtles.com reserves the right, at its sole discretion, to immediately, without notice, suspend or terminate user's registration with or ability to access FitnessTurtles.com and any of its services.

User agrees to indemnify, hold harmless and defend FitnessTurtles.com, its owners, shareholders, directors, officers, employees and agents from and against any action, cause, claim, damage, debt, demand or liability, including reasonable costs and attorney’s fees, asserted by any person, entity, partnership, organization, association or otherwise, arising out of or relating to: (a) this Agreement, (b) User’s use of the FitnessTurtles.com website.
Activities
Through the FitnessTurtles.com platform we provide tools that enable our users to arrange physical meetings for the purpose of group exercise. We do not supervise these activities, even when we are present at them, and are not involved in any way with the actions of any individuals at these activities. As a result, we have no control over the identity or actions of the individuals who are present at these activities, and we request that our users exercise caution and good judgment when attending any activities.
Because we do not supervise or control the activities or interactions among or between members of FitnessTurtles.com and other persons or companies, and because we are not involved in any way with physical transportation to or from activities or with the actions of any individuals at FitnessTurtles.com activities, and because we cannot guarantee the true identity, age, and because we have very limited control, if any, over the quality, safety, morality, legality, truthfulness or accuracy of various aspects of our website you agree that you bear all risk and you agree to release us (and our officers, directors, shareholders, agents, employees, affiliates, subsidiaries, and third party partners) and Organizers and Creators or Leaders and their designees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with your use of the website, your Third Party Transactions, our resolution of any disputes among users, and/or your transportation to or from, attendance at, or the actions of you or other persons at an activity. You further waive any and all rights and benefits otherwise conferred by any statutory or non-statutory law of any jurisdiction that would purport to limit the scope of a release or waiver. You waive and relinquish all rights and benefits which you have or may have under Section 1542 of the Civil Code of the State of California or any similar provision of the statutory or non-statutory law of any other jurisdiction (including without limitation the states of Missouri, Delaware and Pennsylvania) to the full extent that you may lawfully waive all such rights and benefits.
By accepting these Terms of Use I acknowledge that I am at least 18 years of age. I have read these Terms of Use/Release/Waiver Agreement and I understand the words and the language in it. I fully understand the potential dangers incidental to participation and/or receiving instruction in the Activity.
